Data Privacy Framework

This Data Privacy Framework Notice (“DPF Notice”) sets out the principles we follow with respect to the collection, use, and retention  of Personal Data that is transferred from the European Economic Area (“EEA”), the United Kingdom (“UK”) and Switzerland to the U.S.

Participation in the Data Privacy Framework

Valuedynamx, Inc. (“Valuedynamx”) complies with the EU-U.S. Data Privacy Framework (“EU-U.S. DPF”), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (“Swiss-U.S. DPF”) as set forth by the U.S. Department of Commerce. We have certified to the U.S. Department of Commerce that we adhere to the EU-U.S. Data Privacy Framework Principles (“EU-U.S. DPF Principles”) with regard to the processing of personal data received from the European Union in reliance on the EU-U.S. DPF and from the United Kingdom (and Gibraltar) in reliance on the UK Extension to the EU-U.S. DPF. We have also certified to the U.S. Department of Commerce that we adhere to the Swiss-U.S. Data Privacy Framework Principles with regard to the processing of Personal Data received from Switzerland in reliance on the Swiss-U.S. DPF.

Personal Data Collected

The types of Personal Data we receive in the U.S. as well as the purposes for which we collect and use it, are set out in the Valuedynamx Privacy Notice.

Commitment to the DPF

Valuedynamx is responsible for the processing of personal data it receives under the DPF and any subsequent transfers to a third party acting on its behalf. Valuedynamx is committed to complying with the DPF principles for all onward transfers of personal data from the EU, UK and Switzerland, including onward transfer liability provisions.

Jurisdiction

The U.S. Federal Trade Commission has jurisdiction over Valuedynamx’s compliance with the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF. In certain situations, Valuedynamx may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

Dispute Resolution

We commit to resolve complaints about our collection or use of your personal information. EEA, UK and Swiss individuals with enquiries or complaints regarding the DPF principles should first contact us by email at vdxdpaccess@collinsongroup.com or in writing to the contact address provided below.

In compliance with the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF and the Swiss-U.S. DPF, Valuedynamx commits to cooperate and comply respectively with the advice of the panel established by the EU data protection authorities (DPAs) and the UK Information Commissioner’s Office (ICO) and the Swiss Federal Data Protection and Information Commissioner (FDPIC) with regard to unresolved complaints concerning our handling of personal data received in reliance on the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF and the Swiss-U.S. DPF.

For complaints regarding DPF compliance not resolved by any of the other DPF mechanisms, you have the possibility, under certain conditions, to invoke binding arbitration. Further information can be found on the official DPF website.

Transfers to Third Parties

Information about the types of third parties to which we disclose personal data and the purposes for which we do so is described in the Valuedynamx Privacy Notice.

If we have received your personal data in the United States and subsequently transfer that information to a third party acting as an agent, and such third party agent processes your personal data in a manner inconsistent with the DPF, we will remain responsible unless we can prove we are not responsible for the event giving rise to the damage.

Your Data Protection Rights

If you are located in the EEA, UK, or Switzerland, you have the right to request access to the Personal Data we hold about you and request that we correct, amend, or delete your Personal Data if it is inaccurate or processed in violation of the DPF.

If you would like to exercise these rights, please write to us at the contact details below. We may request information from you to confirm your identity and will respond to your request in accordance with the DPF Principles and applicable data protection laws.

It may be necessary for Valuedynamx to make changes to this DPF Notice consistent with the DPF’s requirements, so please check this page occasionally. We will announce any material changes to this DPF Notice via channels appropriate to our relationship with you.
